The complaint alleges that Tesla deceived car purchasers about its Autopilot, Enhanced Autopilot, and Full Self-Driving Capability ("FSD") technology. The lawsuit seeks to represent a class of all those who purchased a Tesla automobile with this technology.</p> <p>The complaint alleges that since at least 2016, Tesla has misleadingly and deceptively marketed its supposed autopilot and full self-driving technology as either already fully functional or just around the corner. </p> <p>Tesla car owners have died in crashes associated with defects in Tesla's Auto-Pilot technology and suffered other serious injuries. resulting in investigations by the National Highway Traffic Safety Administration, the National Transportation Safety Board, and other regulators.</p> <p>On July 28, 2022, the California Department of Motor Vehicles filed an accusation against Tesla for making statements that are untrue or misleading about vehicles equipped with its autopilot and FSD technology. They are seeking to suspend or revoke Tesla's vehicle dealer and manufacturing licenses and potentially require Tesla to pay restitution.</p> <p>Updates provided by Tesla to its Autopilot software and FSD beta software have caused many problems, such as cars having difficulty making routine turns, running red lights, and steering into oncoming traffic. There have also been numerous collisions involving Tesla's purportedly cutting-edge software, including vehicles crashing at high speeds into large stationary objects such as emergency vehicles and an overturned box truck.</p> <p>Frank Bottini, a Partner of Bottini &amp; Bottini, says of the lawsuit:</p> <p>"Consumers who have bought Tesla cars with self-driving capabilities were deceived, and overpaid for their cars, because TESLA knew the cars suffered from many defects that put people's safety at risk." </p> <p>A copy of the complaint is attached below. The case seeks to represent students who attended Ashford University at any time between March 1, 2005 and the present. A copy of the complaint and the Court's order denying defendants' motion to dismiss is attached below.<br /> By Order dated March 26, 2015, the Court denied Plaintiffs' motion for class certification. This means that the Court denied our request to seek redress on behalf of all Ashford University students and held that only the named Plaintiff's claims could be litigated in the lawsuit. We filed a request with the Ninth Circuit Court of Appeals to appeal that decision, which request was denied. On January 25, 2011, due to extensive complaints to us by students who had attended the Heald and Everest group of schools owned and operated by Corinthian, we filed a class action complaint in federal court in Santa Ana, California. A copy of the complaint is attached below. Corinthian chose to attempt to deflect the merits of the claims by moving to compel arbitration of the students' claims. In an order dated October 6, 2011, Judge David Carter refused to require arbitration of Plaintiffs' claims for injunctive relief but did require Plaintiffs to pursue their claims for monetary damages in arbitration based on an arbitration clause which Heald and Everest required their students to sign as part of the enrollment application for the respective schools. Plaintiffs commenced discovery with a view to seeking an injunction barring defendants from continuing to mislead and take advantage of students, including military veterans. Defendants refused to produce any discovery and then appealed Judge Carter's order. Defendants asked the Court to stay all discovery pending their appeal, but the Court denied that request. Defendants subsequently sought an order from the appellate court staying discovery again, which was granted. Thus, at this point, if you are a current or former student of the Heald or Everest group of schools and desire to pursue a claim for monetary damages, you are currently required to commence an arbitration proceeding to pursue any potential damages.
